SMC (Seattle Manufacturing Corporation) Terms and Conditions
Customer terms & conditions apply towards "retail" customer accounts, and purchases made via SMC's website "www.smcgear.com", via phone speaking with an authorized SMC customer service representative, or an authorized SMC distributor. However, products purchased through distributors or alternative sales websites are not eligible for direct return, credit, or refund by SMC and customer should contact point-of-purchase for their product needs.
Terms: All payments are in US Dollars. Established terms for payment for approved open accounts are Net 30 unless otherwise specified in advance from date of shipment. Shipments may be held if a payment is not authorized. Unauthorized or unintentional charges will incur a $20.00 returned payment processing fee. Customer agrees that in the event litigation is necessary to enforce the collection of any amount payable to SMC, or to enforce these Terms, the prevailing party shall be entitled to payment of any and all cost and expenses incurred, including, without limitation, all collection cost and fees, reasonable attorney fees and court cost. Jurisdiction and venue of all claims under these Terms by SMC against a dealer shall be the appropriate state or federal court sitting in Bellingham, Washington USA.
Product Prices and Discounts: SMC reserves the right to change or modify discounts, sales, or prices on all products as it deems necessary without notice. SMC may revoke discounts for any reason at any time.
Shipping Discrepancies: Products or packaging arriving damaged or defective SHOULD NOT BE USED OR PUT INTO SERVICE. If your products arrive damaged; IMMEDIATELY document the issue with pictures, and send an email containing the issues and your order information to customerservice@smcgear.com. We will quickly reply with instructions on fixing your order. Please inspect and read user instructions for all products received (if applicable) before use. SMC must be notified of any shipping errors, discrepancies, and lost or missing items within 15 days of receipt of shipment as termed by the tracking information garnered from shipping services. All losses or damages occurring in transit must be reported to the carrier at the time of delivery. In the event of product damage or request for return, please contact SMC promptly and see "Product Returns & Refunds" below.
Freight/ Shipping: Shipping terms for ALL ORDERS are FOB, Ferndale, Washington, USA. SMC ships orders via UPS and USPS. SMC may decide to ship via an alternate carrier or provider than stated at time of order to save in shipping time or cost at SMC discretion. SMC reserves the right to change shipping costs prior to shipment due to weight or size at time of shipment. SMC does note insure domestic or international retail shipments. All losses or damages to
shipments must be reported to the carrier at the time of delivery. Dealers are responsible for notifying SMC of required shipping accounts, terms, or needs. All shipments are FOB - SMC, Ferndale, WA USA. For international shipments, customer is responsible for all duties and taxes associated with importing an order. If SMC is charged fees, taxes, or duties on a domestic or international shipment that were not agreed to be paid prior to shipment the customer is liable
for those charges and will have fees assessed if unpaid.
Product Return and Refunds: SMC does not replace products with issues pertaining to normal "wear and tear" of a life safety product. If your product is less than 30 days old and little use, and a defect is apparent, please reach out to customerservice@smcgear.com with a detailed description of the issue and included photos. SMC is not responsible for the arrival and condition of items sold by other retailers. If you receive a defective product from a SMC distributor
or retailer/website, please contact them immediately for return and replacement instructions. SMC will issue a "CC" return processing number to the customer prior to return. Specific description and images of damage to product is required before SMC will issue a return ticket. All return charges are issued at customer expense unless explicitly stated otherwise by SMC. SMC will evaluate and approve returned product and approve as they see fit any credits before
a credit is issued. If product is repairable, we will repair and return it as soon as possible. Goods ordered are not subject to return unless defective or at the explicit approval of an SMC customer service representative. If sent the wrong item, or have received an item that appears to be defective, contact our Customer Service Department within 15 days of the date of the shipment and request a Return Authorization Number ("CC NUMBER"). Cost to return goods is paid by buyer unless otherwise agreed by SMC. A 10% restocking fee is applied to ALL returns of nondamaged products.

Warning: SMC products are for mountaineering, rock-climbing and/or rescue use only. Mountaineering, rock climbing and rescue are inherently dangerous.
Any person involved in these activities must obtain qualified instruction of the proper use of these products prior to using them. Any person using these
products is responsible for their own actions/decisions. FAILURE TO FOLLOW WARNINGS CAN CAUSE SERIOUS INJURY OR DEATH. It is the dealer
responsibility to follow and communicate these warnings and risks to customers. SMC is not liable for accidents/injuries/death resulting from products sold
without proper warnings or training.
